3. Bounds / do-not-apply
Applies when:** claiming “open source” in the OSD/software-license sense.
Do not apply this map to:**
- “Open source” as metaphor for transparent government (different instrument)
- Mere publication of source without redistribution rights
- Trademark fights over the phrase outside OSD lock (legal Domain SI may differ by forum)
4. Omissions / floors (declared)
- This L2 map does not adjudicate every OSI license listing decision historically
- Does not score project governance quality (“benevolent dictator” vs company-led)
- **Floor:** marketing language “open source” without a concrete license → label unfit under this map; do not “fix” by community popularity
5. Friction notes (minimum L2)
- Case: public GitHub repo, no license → **fail** job of OSD open-source label
- Case: OSD-approved license, source provided → **fit** under this instrument
- Case: “view source, no forks” proprietary → **distortion** if called open source under OSD lock
6. Neighbors
- Free software (FSF) — related, not identical instrument
- Source-available — neighbor; stricter or weaker rights
- Public domain / CC — different license families
